Independent reseller and brand affiliation

The Timeless Atelier is an independent reseller. We are not affiliated with, endorsed by, sponsored by, or an authorised retailer of any designer brand featured on our website, unless expressly stated otherwise.

All third-party brand names, trade marks, logos and product names belong to their respective owners. References to these names and marks are used to identify and describe the products offered for sale and do not imply any commercial relationship with the relevant brand.

Purchasing an item from The Timeless Atelier does not necessarily entitle the purchaser to the original manufacturer’s warranty, complimentary servicing or other brand-specific benefits. Any such entitlement depends on the relevant brand’s terms.

Preloved and vintage items

Unless expressly described otherwise, our products are preloved or vintage and are not sold as new.

An item’s age, previous use and storage may affect its appearance and condition. We aim to accurately describe each item and disclose known material wear, damage, repairs, recolouring, alterations and missing inclusions.

Condition ratings are a general guide and should be considered alongside the complete product description and photographs. A general description such as “preloved” or “vintage” does not exclude responsibility for undisclosed defects or inaccurate descriptions.

Customers are welcome to request additional photographs or information before purchasing.

Authentication

Authenticity is central to our business. Each item is assessed through our authentication process and supplied with the authentication documentation specified in its listing.

Where Entrupy or another independent authentication provider is used, the resulting assessment or certificate is issued by that provider, not by the original designer brand. It does not imply brand endorsement or affiliation.

References to an authentication provider describe the service used and do not imply any partnership or endorsement beyond a relationship we can substantiate.

Any authenticity concern should be directed to The Timeless Atelier. Our use of an independent authentication provider does not remove our obligations as the seller or restrict customers’ rights under Australian Consumer Law.

Product information and imagery

We take reasonable care to present accurate product descriptions, photographs, measurements and pricing.

Measurements are approximate unless stated otherwise. Colour may vary slightly because of lighting and screen settings. These variations do not excuse a material discrepancy between the item supplied and its advertised description.

Where production dates, collection details or historical information are identified as approximate, including through the use of “circa”, they are estimates based on the information available to us.

Any styling, illustrative or digitally generated images will be identified as such. These images are not intended to represent the exact condition of the item for sale; customers should refer to the actual-item photographs and condition description.

If we discover a material error affecting an order, we will contact the customer and address it in accordance with applicable law. Corrections will not remove rights that have already arisen from a purchase.

Intellectual property

Unless otherwise identified, original website text, photographs, graphics and branding are owned by or licensed to The Timeless Atelier.

You may access and use our website for personal, non-commercial purposes. Except as permitted by law or with the relevant rights holder’s permission, website content must not be reproduced, republished, modified or commercially exploited.

This statement does not claim ownership of third-party trade marks, product designs or other intellectual property belonging to the brands featured.

Third-party websites and services

Our website may contain links to third-party websites or services, including payment, delivery and authentication providers.

These providers operate under their own terms and privacy practices. A link does not, by itself, constitute our endorsement of all content or services available through that website.

Nothing in this section excludes responsibility that The Timeless Atelier has under applicable law.

Consumer rights

Nothing in this notice or our other policies excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

Our goods must meet applicable consumer guarantees, including requirements relating to acceptable quality and correspondence with their description. The assessment of acceptable quality takes account of relevant circumstances, including the item’s age, price, condition and specifically disclosed defects.

Where a consumer guarantee is not met, we will provide the remedy required by law. These rights apply to eligible preloved, vintage and discounted goods.

Applicable law

This notice is governed by the laws of Queensland and applicable Commonwealth laws of Australia.

This does not prevent customers from relying on mandatory consumer protections or accessing a court, tribunal or complaints process available to them under applicable law.

Updates

We may update this notice to reflect changes to our business or legal requirements. The current version will be published on this page with its update date.

Updates will not retrospectively remove rights associated with an earlier purchase.
